Medway Rail Limited intends to enter into two facility access agreements, one with Direct Rail Services Limited (“DRS“) and the other with GB Railfreight Limited (“GBR“), pursuant to the General Approval for Facility Access Agreements (7 February 2018). The agreements have been agreed with DRS and GBR.
In line with the Industry Code of Practice for Track Access Application Consultations and the General Approval, Medway is conducting industry consultation. We are therefore consulting you on the proposed agreements.
The proposed agreements would enable DRS and GBR to access the Port Medway/Medlog Intermodal Container Terminal and associated facilities (“Terminal“) and receive specified services at the Terminal (loading and unloading, maintenance services, and shunting etc). These agreements are intended to replace the existing agreements between DRS and GBR with the current operator from the date that Medway is granted its lease over the Terminal. The agreements meet the requirements necessary to fall within the scope of the General Approval.
Please see below for copies of the proposed agreement:
- Facility Access Agreement between Medway Rail Limited and GBR
- Facility Access Agreement between Medway Rail Limited and DRS
Please note some provisions have been redacted for confidentiality reasons.
Should you wish to comment on either or both agreements, please send your response by email to [email protected] no later than 5pm on Friday 5th January.
Please note your responses will be copied to DRS and GBR and the ORR.
